The Pennsylvania Department of Health has proposed a sweeping rewrite of 28 Pa. Code Chapter 27, the regulations governing communicable and noncommunicable diseases. The proposal—Regulation 10-242 / IRRC #3490—was published August 8 and is not yet final. Pennsylvanians have until September 21, 2026 to submit public comments. A recent investigation by Daily Wire journalist Megan Brock raises serious questions about just how far the proposed regulations could expand the Department of Health's authority. Read Megan Brock's Daily Wire investigation Among the provisions highlighted in Brock's reporting are proposed powers that could allow health authorities to enter schools and other locations during disease investigations, meet and speak privately with students, obtain access to health information, exclude students deemed susceptible to disease from in-person education, and employ broader disease-control measures for the "prevention, containment, or mitigation" of diseases, infections, or certain conditions. Of particular concern to parents, the proposed regulation states that health authorities may "meet and speak with a student or other person in private" during an investigation and that school employees may not obstruct the investigation. The proposal also comes against the backdrop of the Pennsylvania Supreme Court's 2021 decision striking down the statewide school masking order because the Department of Health had exceeded its regulatory authority. The current proposal would substantially revise the regulatory framework governing the Department's disease-control authority. These regulations are proposed—not law—and that distinction is important. The public still has an opportunity to weigh in. The Independent Regulatory Review Commission confirms that the official public-comment period remains open through September 21, 2026.
