Moms for Liberty and the Rev. Jacob Marchitell have filed an Article 78 lawsuit in New York State Supreme Court in Wayne County, seeking an injunction to remove five books from the Clyde-Savannah Junior-Senior High School  library, according to reporting this week by the Finger Lakes Times.

The plaintiffs argue that the books are “sexually explicit and obscene,” and should be taken off the shelves until their lawsuit against the school district and the State  Education Department is resolved.

The contested books include “People Kill People” by Ellen Hopkins, “It Ends With Us” by Colleen Hoover, and “All Boys Aren’t Blue” by George M. Johnson, among others. Despite a school committee’s unanimous decision to retain the books after a review, the school board initially pulled them but later returned them following an appeal.

The State Education Commissioner, Betty Rosa, upheld the decision to keep the books, prompting the current legal action.
